**TERMS AND CONDITIONS**

Rental charges begin at the time equipment leaves Vanguard Computers, Comp U Rent or it agents (hear after referred to as Vanguard) and ends when it is returned or end of rental term whichever is greater. It is the obligation of the renter to notify VANGUARD when the renter wishes to terminate the rental.

Any changes in the order will be billed as due. This includes requests for onsite set-up, networking, and delivery place/area not accessible or not prepared for delivery. Vanguard's current labor rate is $85.00 per hour with a $55.00 minimum charge. Networking charges are $135.00 per hour with a $135.00 minimum charge.

The renter is responsible for the replacement value of all damaged, missing, stolen or lost equipment. Reimbursement to VANGUARD for damages or replacement is due immediately, or rent will be charged until VANGUARD is reimbursed or the equipment is repaired. UNDER NO CIRCUMSTANCES IS THE COMPUTER OR PERIPHERALS COVER TO BE OPENED WITHOUT PRIOR AUTHORITY.

All equipment must be returned to VANGUARD in the same condition as it was received or charges will result. By signing the rental contract the renter acknowledges receipt of the equipment in good order as listed on the contract. CHECK YOUR ORDER

Rented items will only be used at the designated address and only for the purpose for which it was manufactured and intended. Subleasing is prohibited without prior written permission from Vanguard.

We require Mastercard, Visa, Discover or American Express credit cards as a security deposit, checks ARE NOT accepted as deposit. Rental charges are due upon delivery/pick-up. VANGUARD will bill the credit card for any outstanding rental, damage, and cleaning or other charges. We retain security deposit credit card slips until the equipment is completely checked in.

Renter is responsible for all taxes that may be levied by local taxing authorities against rented equipment.

If contract is not extended and the renter fails to return items when due, VANGUARD to protect it's interest under this contract, may retake the items at anytime and to do so may enter renter's property and renter hereby waives any right of action against VANGUARD for such entry and retaking. Renter agrees to pay attorney fees, collection fees, court costs and any other expenses incurred in collecting any charges under this agreement, in retaking the rented items or otherwise enforcing this contract. Failure to return equipment shall be construed as theft and reported to the authorities.

Proof of insurance may be required prior to rental of certain items at our discretion. We reserve the right to refuse service without reason.

All equipment is checked before and after each rental. The renter is expected to know the operations and limitations of the items rented. If we are unable to duplicate problems or failures, the rental charges will stand. Failure to understand the proper operation of equipment will not be accepted as reason for non-payment of rental charges.

VANGUARD IS NOT RESPONSIBLE FOR SOFTWARE CONFLICTS.

In the event of verifiable equipment failure VANGUARD can only be held responsible for the rental charges and not for any related costs. Equipment problems must be reported immediately to VANGUARD to be considered valid reason for non-payment of rental charges.

VANGUARD offers local delivery service. Charges are based upon distance and size of order. Set-up and teardown services are available. Out of town rentals are subject to all the above terms. The renter is responsible for all transportation costs. VANGUARD cannot accept responsibility for the performance of any outside courier or delivery service.

Cancellation Policy

Cancellation of a rental contract prior to 72 business hours of the contract date will result in a cancellation fee of $45 plus the cost of any labor and/or parts committed on behalf of the rental. Cancellation of a rental contract prior to 24 business hours but within 72 business hours of the contract date will result in a cancellation fee of 50% of the rental contract plus the cost of any labor and/or parts committed on behalf of the rental. Cancellation of a rental contract within 24 business hours of the contract date will result in a cancellation fee of 100% of the rental contract.

Renter assumes all risks inherent in the operation and use of the item(s) and agrees to assume the entire responsibility for the defense of, and to pay, indemnify and hold Vanguard Computers, Inc harmless from and release from any and all claims for damage to property or bodily injury (including death) resulting from use, operation or possession of the item(s) whether or not it be claimed or found that such damages or injury resulted in whole or in part from VANGUARD'S negligence, from the defective condition of the equipment or any cause.
